Legal Literacy: Why it matters for small business owners

What if we told you that fundamental to the operation of our democratic society is that the law is known, it is accessible, and that ignorance of the law is no defence to it? This is the rule of law. In short, the rule of law says that everyone is subject to the same laws, and no one is above the law. 

The rule of law provides a framework for resolving disputes and protecting rights. Laws establish standards of behavior that society expects individuals and organisations to follow. Knowing these standards helps people comply with the law and avoid legal troubles. It also promotes fairness and justice by ensuring that everyone understands what is expected of them.

Does that make you, a small business owner, reflect on how much you know about the law and how it applies to you and your business? Does that make you question your legal literacy?

What Does It Mean to Be Literate?

Before we look at legal literacy, let’s discuss what it means to be literate generally. When we talk about literacy, the first thing that comes to mind is the ability to read and write. This fundamental skill forms the basis of education and communication in society.

However, literacy extends far beyond just reading and writing. It encompasses various forms of knowledge and competence in specific areas crucial for navigating modern life. Two prominent examples are financial literacy and computer literacy.

Financial literacy involves understanding how to manage personal or business finances effectively. This includes budgeting, saving, investing, and understanding financial products and services. In today’s world, financial literacy is essential for making informed decisions that can lead to financial stability and growth, especiall for small business owners.

Similarly, computer literacy is the ability to use digital devices, software, and social media platforms proficiently. As technology continues to evolve, being computer literate is vital for both personal and professional interactions. It enables individuals to access information, communicate efficiently, and participate fully in the digital age.

What is legal literacy?

While many small business owners have some level of financial and computer literacy, another critical area often overlooked is legal literacy. Legal literacy is the knowledge and understanding of the laws that govern our lives and our businesses. It is the ability to recognise when a legal issue arises and to communicate effectively with a variety of stakeholders, including staff, vendors, business partners and lawyers about those issues.

The legal system can be complex and intimidating. Many people find it challenging to understand how the law applies to specific situations. This confusion can lead to anxiety and overwhelm, especially when legal issues arise and there is a need to seek legal advice from a qualified lawyer. 

However, legal representation can be expensive which makes it inaccessible for many people. Those who cannot afford legal services might not receive the help they need, leading to unfair outcomes. Legal literacy enables individuals to navigate legal processes more effectively, even if they cannot afford a lawyer. It also helps them make better use of free or low-cost legal resources.

Legal literacy involves having a basic understanding of the law, how it affects you and your small busienss, and how to comply with it. It is about knowing your legal rights and responsibilities as a small business owner. Legal literacy empowers you, as a small business owner, to make informed decisions, protect your business interests, and engage with lawyers and the legal system when necessary.

Legal literacy enables individuals to navigate legal processes more effectively, even if they cannot afford a lawyer. It also helps them make better use of free or low-cost legal resources.

The Specific Challenge for Small Business Owners

Every day, as individuals and as small business owners, we all have multiple touchpoints with the law. As small business owners, you must be aware of and adhere to a plethora of laws that apply to your specific day-to-day operations, some of which you might not even know about!

But in a world where legal education is usually reserved for only the academically gifted, how do you, as ordinary citizens, educate yourselves to a degree that you understand how the law applies to you so that you can obey it?

The reality for most small business owners is their legal literacy is limited to one, maybe two subjects they have done as part of their tertiary or vocational education. However, numerous small business owners may not have any benefit of basic legal education at all.

So why does it matter?

Legal literacy is an essential skill that empowers individuals to navigate the complexities of the legal system. It promotes fairness, protects rights, and ensures that people can make informed decisions. By understanding the laws that affect you, identifying legal issues, and communicating effectively about them, you become legally literate.
